Pursuant to the Working Conditions Decree, the detection of conventional explosives (CE) left behind in the (water) soil as a result of the Second World War may only be carried out by companies that are certified to do so.

The legal basis and scope of this certification obligation is explained below.

Article 4.10 of the Working Conditions Decree stipulates that companies that perform activities related to detecting Conventional Explosives (CE) must be in possession of a "process certificate for detecting conventional explosives issued by Our Minister or a certifying body". The certification requirement has applied since 2007.

Article 4.17f of the Working Conditions Regulation refers to the WorkSpecific Certification Scheme for the System Certificate for Conventional Explosives Detection (WSCS-OCE), as included in Appendix XII of the Working Conditions Regulation, as the basis for the certification of detection companies.

Certification of investigation companies is done by certification institutes appointed for this purpose by the Minister of SZW. Currently, only TÜV Nederland has been designated as such.

The Working Conditions Act and regulations apply to everyone performing work in the Netherlands (Section 1 of the Working Conditions Act), even if this work is performed by a foreign company. On the basis of Section 2 of the Working Conditions Act, this "Act and the provisions based thereon" also apply to work carried out within the Exclusive Economic Zone (EEZ).
